Conditions of Use
COPY of LICENCE CONDITIONS and LIMITED WARRANTY
These conditions of use apply to all editions, versions and Special Editions of GPS Utility.
The GPS Utility software is owned by A S Murphy.
Any data or maps associated with Special Editions of GPS Utility are the property of the "Special Edition Provider" and are covered by these conditions of use.
GPS Utility is provided as an aid for managing and mapping GPS information. The software and/or any associated data is not to be used as a primary source of navigation nor as a means for piloting or guiding vessels or vehicles nor for any safety relevant purpose.
It is the users responsibility to first ensure that the information provided is suitable for the intended usage.
The software is provided on an 'as is' basis only and no warranties are given.
Both A S Murphy and any Special Edition Provider give no warranties, either expressed or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose, with respect to the software and any associated data or maps. We do not claim that the software and/or associated data is error free or 100% accurate.
LIMITATIONS OF LIABILITY
A S Murphy or any Special Edition Provider shall not be responsible for any consequences arising out of the use of GPS Utility and/or any associated data. In no event will we be liable for any damages including any lost profits, lost savings, or other incidental or consequential damages arising out of the use or inability to use the software or for any claims by any other party even if we have been advised of the possibility of such damages. The use of the software and data is at the exclusive risk of the user.
GRANT OF LICENCE
This is an agreement between you the user (entity or person) and A S Murphy. By using GPS Utility (referred to as the 'software') you are agreeing to become bound by the terms of the agreement.
Freeware Version License
The Freeware version is available via download from www.gpsu.co.uk. The user may freely distribute the unmodified EXE (or ZIP) file to others provided no charge is made and also provided that the distribution is accompanied by information informing users that they may obtain updates and registration details from the website www.gpsu.co.uk.
By downloading or installing the GPS Utility software, you are agreeing to be bound by the terms of this agreement. If you do not agree to the terms of this agreement, delete the software and any accompanying items from your system.
Registered Version Single License
The author grants the user the right to use a copy of GPS Utility on a single computer. This is a single use non-concurrent license. The software is "in use" on a computer when it is loaded into the temporary memory (i.e.RAM) or installed into the permanent memory (e.g. hard disk, CD ROM, or other storage devices) of that computer. However an exception is made for a single 'field' laptop when used by the same person in conjunction with a desktop machine. In this case both installations are treated as a single installation.
You may access the software through a network, provided that you have registered an individual copy for each workstation that will access GPS Utility through the network regardless of whether the software is used at different times or concurrently.
The registration name should be specific to and describe the user or user group. The user may not transfer the registration name and details to anyone else outside his organisation or publish the information.
Site Multiple License
The Site Multiple License Document, which is sent to the user on purchase of a Site Multiple License, amends the Registered Version Single License conditions so as to deal with multiple users. This relates only to the software and not to any Special Edition Associated Data.
Special Editions Associated Data License
Unless otherwise specified by the Special Edition Provider, any associated Data and/or Maps are to be treated like any other copyrighted material (e.g. a book) - see COPYRIGHT below.
GPS Utility and any associated data and maps are protected by copyright laws, international treaty provisions, and applicable national laws. All rights to the software remain the sole property of GPS Utility Limited. You may not make copies of the software for the purposes of monetary gain.
You may not copy any data or maps associated with Special Editions except with the prior agreement of the Special Edition Provider.
You may not alter, merge, modify or adapt this software in any way including disassembling or decompiling or reverse engineering. You may not loan, rent, lease or license this software or any associated data or any copy.
GPS Utility is under development and may contain software bugs. Users should therefore take precautions when running GPS Utility, such as saving all data in other programs before running the program. GPS Utility Limited welcomes feedback concerning the software. Please see service and support
TERMINATION OF LICENSE
The license will terminate automatically if the user fails to comply with any condition of the license.
WITHDRAWAL OF FUNCTION
A S Murphy does not guarantee that any particular functions will continue to be supported in future versions. A S Murphy reserves the right to withdraw function at any time without giving any reasons. Function may be withdrawn when, for example, other parties change the format of files which are currently supported by GPSU, but which can no longer be supported once a format change has been made.
The conditions of use relating to GPS Utility are covered by the Law of England. The conditions relating to any Special Edition associated data and/or maps are covered by the laws of the country of the data provider.
